Barrett Law Group, P.A. Settles Lawsuit With GSK and Biovail Over Antitrust Violations

Barrett Law Group, P.A. represents Professional Drug Company, Inc., which brought a putative class action against GlaxoSmithKline and Biovail for antitrust violations related to the drug Wellbutrin XL. The class action is brought on behalf of all direct purchasers of Wellbutrin XL. Barrett Law Group, P.A. alleged that GSK and Biovail violated antitrust law by unlawfully precluding generic Wellbutrin XL from getting to the market. GSK’s and Biovail’s unlawfully behavior caused direct purchases to pay higher prices for Wellbutrin XL. The settlement was for $37.5 million. Biovail alone settled this case so the case against GSK proceeds. A final fairness hearing is scheduled for November 7, 2012 in Philadelphia, PA federal court.
